By accessing or using Nimlyst’s Virtual Assistant Placement Services (the “Service”), you agree to the following Terms and Conditions. Please read them carefully as they govern your use of the Service and set forth your rights and responsibilities

1. Service Overview

1.1 Nimlyst provides a comprehensive recruitment, vetting, and training service to help customers identify and hire qualified Virtual Assistants (VAs). By using our Service, you understand and agree to the steps of the placement process, which include:

Payment of a $197 Placement Fee. Completion of a client requirements form to outline the desired candidate’s qualifications and skills. Scheduling and conducting interviews with candidates pre-selected by Nimlyst based on your requirements.

1.2 Minimum Commitment: When hiring a Virtual Assistant (VA) through Nimlyst, the customer agrees to a minimum commitment of 3 months. This ensures that the VA feels confident and secure in their employment position.

1.3 VA Replacement Policy: During the 3-month period, Nimlyst will replace the VA for any reason if they are not meeting your expectations or requirements.

1.4 Monthly Auto-Billing: After the initial 3-month commitment, the customer will stay enrolled in monthly auto-billing. The service will continue on a monthly basis unless the customer provides notice to cancel.

1.5 Cancellation Policy: After the 3-month commitment, customers may cancel their agreement at any time with at least 7 days' notice prior to their next billing date.

2. Placement Fee

2.1 The $197 Placement Fee is a non-refundable fee. This fee covers the costs associated with:

Recruiting potential candidates.Vetting candidates for quality and reliability.Training candidates to meet the general expectations of Virtual Assistant roles.

2.2 By paying this fee, you acknowledge that the fee is used for the resources and effort involved in the recruitment process, regardless of whether you ultimately hire a candidate presented by Nimlyst.

3. Non-Refundable Fee Policy

3.1 All placement fees are non-refundable under any circumstances. Once paid, the fee will not be reimbursed, including but not limited to situations where:

You choose not to move forward with the candidates provided. You decide to discontinue the recruitment process after payment. The Service is terminated due to a breach of these Terms and Conditions.

3.2 Nimlyst’s obligation is to present qualified candidates for your consideration; however, the hiring decision ultimately rests with you, and no guarantees of employment outcomes are made.

4. Candidate Selection and Interview Process

4.1 After receiving your completed client requirements form, Nimlyst will identify and provide candidates for your review.

4.2 Interviews will be scheduled based on your availability and the availability of the candidates.

4.3 Nimlyst does not warrant or guarantee that all candidates will meet your specific needs or preferences, but we will make every reasonable effort to match candidates to the provided requirements.

5. Customer Responsibilities

5.1 You are responsible for:

Providing accurate and complete information regarding your requirements during the onboarding process.Attending scheduled interviews promptly.Making hiring decisions based on the candidates presented.

5.2 Any failure to fulfill these responsibilities may result in delays or disruptions to the placement process, for which Nimlyst will not be held liable.

6. Confidentiality

6.1 You agree to maintain the confidentiality of any personal or professional information shared by candidates during the recruitment process.

6.2 Nimlyst agrees to protect and maintain the confidentiality of your information in compliance with applicable data protection laws.

7. Limitation of Liability

7.1 Nimlyst is not liable for:

The performance or conduct of any Virtual Assistant after hiring.Any loss or damages arising from the hiring process or employment relationship.

7.2 The Service is provided “As Is,” without warranties of any kind, express or implied.

8. Termination of Service

Nimlyst reserves the right to terminate the Service at any time if you breach these Terms and Conditions. In such cases, no refunds will be issued.

9. Changes to Terms and Conditions

Nimlyst reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the Service constitutes acceptance of the updated Terms and Conditions.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Colorado. Any disputes arising from these terms shall be resolved in the courts of Colorado.
